Veteran Attorney-at-law David Brandt Awaits Judgement in a Civil Matter Involving Commissioner of Police et al

A judgement in a civil matter involving Veteran Attorney-at-law David Brandt and the Commissioner of Police et al will be delivered this week.

Confirmation of this came from the Court Office on Friday.

In the notice issued, the judgement is scheduled to be delivered on Friday February 14th at the Court of Appeal Sitting in St Kitts and Nevis at 9 a.m.

Mr Brandt’s attorney Dr David Dorsett is arguing that his constitutional right to privacy and correspondence was breached when the officers responsible for his client’s arrest made an extra step of searching his cellphone and downloading its contents.

A search warrant was granted by the Magistrate court for Mr Brandt’s property; however, Dr Dorsett is arguing that there was no judicial authorization granted to allow the search and downloading of the contents on the cellphone.

Meanwhile, the prosecution, Annesta Weeks retorts that the warrant issued by the court “should”, without saying, cover the arrest, the search of the property, including the cellphone and its contents.

Weeks argues that taking into consideration the seriousness of the case, all parties should have been cognizant of the fact that, when found, the cellphone would have been subjected to a search.

Both sides made their submission to the panel of judges, which includes President of the Court of Appeal, Justice Mario Michel, Justice John Carrington Q.C and Justice Paul Webster Q.C on January 27th and has since been awaiting judgement.
