Claims Made By Real Estate Developer Inaccurate, says Attorney General
The Attorney General (AG) has issued a statement to the media denying claims made by Real Estate Developer Harvey Edgecombe in his contribution on the Breakfast Show Thursday morning. The AG labelled as inaccurate, claims made by Edgecombe that the court in the UK accepted his application for permission to apply for Judicial Review in the Administrative court in the UK.
The Attorney General Mrs. Sheree Jemmotte Rodney said the judge denied Mr. Edgecombe’s request indicating that the nature of the allegations in the case are pre-eminently ones for the local courts to pursue.
The court expressed that to bring proceedings in the high court of Montserrat is an adequate alternative remedy to bringing judicial review proceedings in the UK against the Foreign and Commonwealth Office and Ministry of Finance. The UK court also made note of the fact that the application for permission to apply for review was filed out of time, outside of the UK and without the permission of the Court.
The Judge therefore indicated that he was not satisfied of any arguable allegation of a violation of the constitution by the Premier Donaldson Romeo. He is also not satisfied that there is good reason for an extension of time to bring such a challenge .
The AG said she is also not aware of any court hearing date set in this matter for November 18 2019.Mrs. Jemmotte Rodney says neither the AG’s Chambers nor anyone representing the Ministry of Finance has been served with any further court documents related to the matter.
The matter of Edgecombe taking legal action against the government came to light when the real estate developer called in to the programme “What’s on your mind” to discuss the matter.
